ASSISTANT FEDERAL DEFENDER (Hammond Division)

NORTHERN DISTRICT OF INDIANA FEDERAL COMMUNITY DEFENDERS, INC.

Job description:

The NORTHERN DISTRICT OF INDIANA FEDERAL COMMUNITY DEFENDERS, INC. [hereinafter: “NDIFCD”], a non-profit, private corporation funded by the Administrative Office of the U.S. Courts, is accepting applications for the position of assistant federal defender in the Hammond Division of the United States District Court for the Northern District of Indiana. The NDIFCD provides, under authority of the Criminal Justice Act, 18 U.S.C. § 3006A, defense services to individuals charged with federal criminal cases and related matters who are financially unable to retain counsel.

Requirements:

An assistant federal defender in the NDIFCD must be: (1) a graduate of an accredited law school and admitted to practice in good standing before the highest court of a state; (2) licensed to practice in the United States District Court for the Northern District of Indiana on the date employment with the NDIFCD begins. Appointment may also be subject to a satisfactory background investigation to include interviews with former employers and professional contacts and a criminal history check consistent with employment laws. In the letter of interest, the applicant should disclose if he or she has been reprimanded (publicly or privately) or suspended from the practice of law by any jurisdiction.

Duties:

The assistant federal defender will represent clients charged with federal criminal offenses and ancillary matters in the district court. The position will require travel for investigation, litigation, and training on occasion. An assistant federal defender may not engage in the private practice of law while employed with the NDIFCD.

Selection Criteria:

The successful applicant will have an established capacity and clearly demonstrated aptitude for excellence in criminal defense practice, a commitment to the representation of indigent accused persons, and a reputation for personal integrity. The successful applicant should have significant trial experience in either state, federal or military courts and the ability to handle a robust caseload. At a minimum, the successful applicant should have tried at least 5 criminal jury trials in any court.

Salary & Benefits:

The salary of an assistant federal defender will be based on qualifications and experience. The position includes a comprehensive benefits package, featuring health, dental, vision, and life insurance; annual leave and sick leave. Employees also receive 11 paid federal holidays, annual retirement contribution; and regular continuing legal education opportunities.

Junior Staff Attorney in the Trustee’s office in Mishawaka, IN.

Tracy L. Updike, Chapter 13 Standing Trustee for the Northern District of Indiana – South Bend, Fort Wayne and Lafayette Divisions, is accepting applications from qualified individuals for employment as a junior staff attorney in the Trustee’s office in Mishawaka, IN.

Job Summary:

The position is a full-time, in person position (at least, initially) and is available immediately. There is possibility of part-time work from home once fully up to speed. Duties include representation of the Standing Trustee before the Bankruptcy Court and conducting Meetings of Creditors. The staff attorney must assist the Standing Trustee in investigating the financial affairs of debtors and in meeting the duties of a fiduciary, which require the diligent exercise of good faith in administration of the estates under the Standing Trustee’s supervision. Bankruptcy education or extern, intern or work experience is preferred. Candidates must be eligible for admission to practice in the United States Bankruptcy Court for the Northern District of Indiana, which simply requires admission to the highest court of any state. Passage of the Indiana Bar, while not initially necessary if a foreign license is held, will be a goal. The successful candidate must possess strong verbal, writing and interpersonal skills, and the ability to handle a high-volume caseload. Salary is commensurate with this entry level position.

To be qualified an applicant should possess integrity and good moral character; be free of prejudices which would interfere with unbiased performance of the staff attorneys’ duties; and be unrelated by affinity or consanguinity within the degree of first cousin to a Bankruptcy Judge presiding in the Northern District of Indiana, the Bankruptcy Clerk of Court, the U.S. Trustee for Region 10 or the Assistant U.S. Trustee for the South Bend Office of U.S. Trustee. Compensation:

The staff attorney’s annual salary and benefits are part of the Standing Trustee’s annual operating budget, which is subject to review and approval by the U.S. Trustee. The approved salary for the staff attorney position is $82,774 to $124,160. In addition to this salary, benefits presently include, subject to applicable participation requirements:

Fully paid health, dental, and vision insurance for the employee.

A minimum of 10 paid Federal holidays per year.

Job Description and minimum qualifications:

Paul R Chael, the Standing Chapter 13 Trustee for the Northern District of Indiana, Hammond Division Bankruptcy courts is seeking applications from qualified individuals for employment as a staff attorney. The staff attorney would be part of a team to assist and represent the Trustee in complying with all provisions of the United States Bankruptcy Code and Rules as well as the requirements of the US Bankruptcy Courts for the Northern District of Indiana and the Office of the United States Trustee. Included duties would be: Review of Bankruptcy Schedules and Statements, and Chapter 13 Plans filed by debtors, review and drafting of pleadings, including motions, objections, briefs and other pleadings filed in bankruptcy court proceedings, conduct of section 341 meetings of creditors, appearance in wide variety of bankruptcy court proceedings, including confirmation hearings, Occasional appellate work may be included. Additional duties would be assigned as needed to help the Trustee implement legal policies and procedures. Some travel is required for periodic training purposes and court appearances in the Northern District.

Minimum requirements:

Member in good standing of the bar, admission to the U $ District Court for the Northern District of Indiana, (or qualification for such), Minimum of 5 years’ legal experience, including some experience in Chapter 13 bankruptcy matters, sufficient computer skills to be able to use the Trustee case management software, Proficiency in legal writing and analysis, familiarity with electronic case filing (ECF) and Pacer. Excellent organizational skills are needed. Ability to manage an extensive and busy calendar without issue. Candidates selected will be subject to background investigation. Neither interview nor relocation expenses will be authorized, paid or reimbursed by this office. This position wilt be open until it is filled.
